Getting Your License Back

Following an arrest for DWI, your license will be suspended for 30 days. It may be possible to contest the suspension on the basis of no probable cause if you request a hearing before the magistrate within 10 days of your arrest. In some situations, Bryan Smith can file a petition with the Department of Motor Vehicles and represent you in the hearing in an effort to get your license restored or to get limited driving privileges for you (a “hardship license”) pending the outcome of the criminal case.

Our firm will, of course, provide aggressive representation regarding the criminal DWI charge. Our goal will be to get a dismissal of the charge, reduction to a non-alcohol-related driving offense or a not guilty verdict. If we succeed, we can seek to fully restore your driver’s license.

What Happens If I Am Convicted?
